Swansea man alleged to have defaulted on $7,000 loan

BELLEVILLE – A Millstadt individual alleges a Swansea resident failed to pay a loan in full.

Robbin Mabery filed a complaint on Aug. 11 in the St. Clair County Circuit Court against Mark Wasilewski alleging breach of contract.

According to the complaint, the plaintiff alleges that on June 5 she entered into a written contract with defendant whereby she loaned the sum of $7,000 secured by defendant's 2013 Harley Davidson motorcycle and defendant agreed to pay $250 each month commencing July 1. She alleges that the defendant made the first payment, however no subsequent payments have been made despite plaintiff performing all of her obligations under the terms of the agreement. 

The plaintiff holds Wasilewski responsible because the defendant allegedly failed to fulfill obligation under the agreement, failed and refused to pay the money owed due and owing and failed to turn over possession of the 2013 Harley Davidson as agreed.

The plaintiff seeks damages of no more than $50,000, plus pre- and post-judgment interest, attorney fees and costs. She is represented by Chet A. Kelly of Foley & Kelly LLC in Belleville.
