Customer sues Dollar General over slip, fall

BELLEVILLE — A customer is suing Dollar General after she allegedly slipped and fell on a gel air freshener near the register. 

Julia Whitney filed a complaint on Aug. 23 in the St. Clair County Circuit Court against DG Retail, LLC, doing business as Dollar General, alleging it failed to maintain its property in a reasonably safe manner.

According to the complaint, the plaintiff alleges that on Aug. 25, 2015, she was on the defendant's premises when an existed gel air freshener on the floor near the register area presented an unreasonable risk of harm to its customers. Whitney claims she slipped on the gel air freshener, causing her to fall. 

As a result, Whitney claims she suffered physical injuries, loss of a normal life and incurred medical expenses. 

The plaintiff alleges Dollar General failed to warn customers of the presence of gel air freshener on the floor, failed to clean up the gel air freshener that was on the floor and failed to barricade the area surrounding the gel air freshener.

The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs, and for such other further relief as the court deems just and proper.
