BELLEVILLE – A carpenter alleges exposure to asbestos during his career caused lung cancer.
Theodore Hiatt filed a complaint on Aug. 4 in the St. Clair County Circuit Court against CBS Corp., formerly known as Viacom Inc.; Crown Cork and Seal Co. Inc.; CSR LTD, et al. alleging negligence.
According to the complaint, the plaintiff alleges that between 1959 and 2007, he was employed as a carpenter/laborer and claims he was exposed to and inhaled asbestos fibers and/or asbestiform fibers emanating from certain products he was working with and around, which were manufactured, sold, distributed or installed by the defendants. On Nov. 10, 2016, he first became aware that he had developed lung cancer, the suit states.
The plaintiff holds the defendants responsible because they allegedly failed to provide adequate warnings and instructions concerning the safe methods of working with and around the products, including specific instructions on how to avoid inhaling the asbestos fibers.
The plaintiff seeks judgment for compensatory and punitive damages in the amount of more than $50,000 and for such other and further relief that the court deems appropriate. He is represented by Ethan A. Flint and Laci M. Whitley of Flint Law Firm LLC in Edwardsville.
