A.W. Chesterton, others named in man's asbestos exposure lawsuit

BELLEVILLE – A man alleges his lung cancer was caused by decades of exposure to asbestos.

Richard Boley and Marily Boley filed a complaint on July 17 in the St. Clair County Circuit Court against A.W. Chesterton Inc., A.O. Smith Corp., Armstrong Pump Co., et al., alleging negligence.

According to the complaint, the plaintiffs allege that during Richard Boley's career from 1959 to 2014, he was exposed to and inhaled, ingested or otherwise absorbed asbestos fibers emanating from certain products of the defendants. The suit states Richard Boley was diagnosed with lung cancer on May 8, 2017, an asbestos-induced disease. 

The plaintiffs allege the defendants failed to provide warnings to people working with or around the products, failed to provide adequate instructions on how avoid inhaling asbestos and failed to conduct tests on the asbestos-containing products.

The plaintiffs request a trial by jury and seek judgment for compensatory, punitive and exemplary damages in an amount of more than $50,000, such other and further relief as the court deems appropriate. They are represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
