AGEE JAMES  V.  MADISON COUNTY ILLINOIS

16-L-000815, RUTH 311

(D/MOTION TO DISMISS FIRST AMENDED COMPLAINT)

Background: Circuit Judge Dennis Ruth last year granted the County's motion to dismiss plaintiff James Agee's suit alleging he was discriminated against because of his gender by being forced to wait while exchanging custody of his child. Ruth also allowed Agee, represented by Tom Maag of Wood River, to amend his complaint.

The upcoming hearing scheduled for 9 a.m. is to hear County's motion to dismiss Agee's first amended complaint.

Agee alleges he was forced to sit and wait for 30 minutes each time he exchanged custody of his child. He alleges Madison County failed to provide neutral treatment, including a “first-in first-out rule.”

Represented by John Gilbert of Sandberg Phoenix in Edwardsville, the County argues that it is not a proper defendant because it does not operate "The Madison County Kids Corner," a custody exchange program.
