BELLEVILLE — A woman is suing numerous companies alleging second hand exposure to asbestos caused her to develop mesothelioma.
Markesha Davis filed a complaint on June 22 in St. Clair County Circuit Court against Armstrong Pumps Inc., Avinmeritor Inc., Aurora Pump Company et al. alleging that the defendants failed to exercise reasonable care and caution for the safety of their employees and others working with or around their products.
According to the complaint, the plaintiff alleges that she was secondarily exposed to asbestos-containing products through her cousin, uncle and mother as they previously worked for some of the defendants. Due to her close proximity to asbestos, the plaintiff claims she was first diagnosed on Jan. 18, 2017.
The plaintiff holds the defendants responsible because they allegedly failed to provide warnings to people working with or around the products, failed to provide adequate instructions on how to avoid inhaling asbestos and failed to conduct tests on the asbestos-containing products.
The plaintiff requests a trial by jury and seeks judgment for compensatory, punitive and exemplary damages in an amount in excess of $50,000, and for such other further relief that the court deems appropriate. She is represented by Barry Julian of Gori, Julian & Associates PC in Edwardsville.
