Gateway Roofing, driver sued over O'Fallon crash

Car accident 38

BELLEVILLE — Two plaintiffs are suing the owner of a roofing company and a driver, alleging negligence for striking their vehicle and causing injuries.

Robert Novack and Aziza Novack filed a complaint on May 15 in St. Clair County Circuit Court against Robert Edsall and Dan J. Cadigan, individually and doing business as Gateway Roofing Contractors Inc., alleging negligence.

According to the complaint, the plaintiffs allege that on May 16, 2015, Robert and Aziza Novack were severely injured when their vehicle was struck by Cadigan's pickup truck while it was being operated by Edsall in O'Fallon.

The plaintiffs claim they suffered severe and permanent injuries that hindered them from attending to their usual duties and affairs.

The plaintiffs allege Edsall failed to keep the vehicle under proper control and failed to maintain careful lookout and Cadigan failed to entrust his vehicle to a driver with reasonable care for the safety of others.

The plaintiffs request a trial by jury and seek judgment against each defendant in excess of $50,000 for each plaintiff, plus costs of this suit.

They are represented by Kenneth B. Beljanski of Brown & Brown LLP in Fairview Heights.
