Suit alleges CR Property Investments, owner rented to tenants despite black mold

EDWARDSVILLE — A family alleges they were unaware that their rental property in Alton contained harmful mold

Patrick Phillips and Chasity Phillips, individually and as guardian of minors Carter Phillips, Ophelia Phillips, Austin Brown and Elijah Phillips, filed a complaint on May 23 in the Madison County Circuit Court against Rashaad Robinson, CR Property Investments LLC, CR Investments LLC and Robinson Realty, alleging they negligently failed to maintain a habitable property.

According to the complaint, the plaintiffs allege the defendants did not warn them of the black mold in the rented property. 

As a result of their exposure to black mold, the plaintiffs claim they sustained permanent injuries resulting in pain, mental anguish and disability and incurred medical-related expenses. 

The plaintiffs allege the defendants failed to prevent the growth of black mold, failed to rectify the black mold problem and failed to warn plaintiffs regarding the presence and dangers of black mold infestation.

The plaintiffs request a trial by jury and seek judgment against the defendants in an amount in excess of $75,000.
