BELLEVILLE — A welder is suing Canadian National Railway for allegedly failing to provide safe equipment for him to use after he was put on oxygen therapy for his pulmonary fibrosis.
David A. Phelps filed a complaint on March 21 in the St. Clair County Circuit Court against Illinois Central Railroad Company, d/b/a Canadian National Railway, alleging it failed to provide the plaintiff a reasonably safe working environment.
According to the complaint, the plaintiff alleges that on June 24, 2016, he was diagnosed with pulmonary fibrosis and was permanently placed on oxygen therapy. He claims that as a welder he was required to work in tight and confined spaces. He alleges his employer failed to provide proper safety equipment for him while performing his duties at work.
The plaintiff seeks judgment against the defendant in an amount that exceeds $50,000 plus court costs.
