Passenger alleges intoxicated driver hit parked car

EDWARDSVILLE — A passenger is suing a driver, alleging she was intoxicated while driving and caused a collision in Alton.

Lexie Braxton filed a complaint on May 28 in the Madison County Circuit Court against Mallory L. Wuellner, alleging the defendant failed to exercise ordinary care in operating her motor vehicle.

According to the complaint, the plaintiff alleges that on March 14, 2016, she was a passenger in a parked vehicle facing northbound on the east side of the 900 block of Washington Avenue Wuellner left her traffic lane and allegedly struck the plaintiff's vehicle. 

As a result, Braxton claims she suffered physical injuries, lost wages and medical expenses. 

The plaintiff alleges Wuellner drove the motor vehicle while impaired, failed to reduce speed and failed to drive in a proper lane of traffic.

The plaintiff requests a trial by jury and seeks judgment in an amount that exceeds $50,000, plus costs of suit and other further relief which the court deems proper.
