Passenger sues driver following rear-end collision on Route 3

BELLEVILLE — A passenger is suing a motorist for allegedly causing a rear-end collision. 

Carla M. Mitan filed a complaint last month in St. Clair County Circuit Court against Danny L. Elbrecht, alleging he failed to exercise due care and caution in the operation and control of his vehicle to avoid injuries to others.

According to the complaint, the plaintiff alleges that on May 7, 2015, she was a passenger in a car traveling southbound on Illinois State Route 3 in Sugar Loaf when the vehicle's rear was struck by the defendant's vehicle near the intersection of Mule Road. 

As a result, Mitan claims she suffered physical injuries, pain and medical expenses. 

The plaintiff alleges Elbrecht failed to give audible warning with the horn, failed to keep a proper and sufficient lookout for other vehicles present and failed to apply brakes in time to keep from losing control of the vehicle.

The plaintiff requests a trial by jury and seeks judgment for damages greater than $50,000 plus costs of suit and other further relief to which the court deems just.
