EDWARDSVILLE — A former employee is suing a Collinsville video gaming business for alleged termination in retaliation for exercising his right to medical leave.
Kevin Busby filed a complaint on March 20 in the Madison County Circuit Court against Accel Entertainment Gaming LLC, alleging the defendant violated the Illinois Workers' Compensation Act (IWCA).
According to the complaint, the plaintiff alleges that on Sept. 5, 2015, he reported an injury that happened during his employment to the defendant and sought medical leave and benefits. He claims he was taking time off work per the orders of a physician. On Jan. 25, 2017, he was terminated from his employment.
As a result, Busby claims he suffered loss of income and benefits and experienced emotional distress.
The plaintiff alleges Accel failed to provide him the right to a medical leave and intentionally terminated him for exercising his rights under the IWCA.
The plaintiff requests a trial by jury and seeks judgment in excess of $50,000 plus costs of this suit and any other further relief the court deems just.
