Daimler Chrysler sued over alleged faulty airbag system

BELLEVILLE — An Illinois man is suing after the airbag in his Chrysler Crossfire allegedly failed to deploy in a collision.

Timothy Abbott filed a complaint on March 16 in St. Clair County Circuit Court against FCA US LLC, Daimler Chrysler, TK Holdings Inc. and others, alleging they failed to design a reasonably safe motor vehicle.

According to the complaint, the plaintiff alleges that on March 23, 2015, he collided with another vehicle while driving his Chrysler Crossfilre. He claims the collision caused damages to the front and driver side of his Crossfire. Abbot claims he sustained catastrophic injuries due to the failed deployment of airbags. 

The plaintiff holds the defendants responsible because they allegedly failed to design, manufacture, market, advertise, distribute and sell the Crossfire with an adequate and crashworthy airbag control and sensor system; failed to implement sufficient quality control to ensure that all distributed and sold vehicles are safe and non-defective; and failed to warn or provide sufficient notice, recall and repair information to consumers and users regarding the defective safety systems of the vehicle.

The plaintiff requests a trial by jury and seeks judgment in a dollar amount in excess of the jurisdictional limitation of the court and any other further relief the court deems just.
