BELLEVILLE — A driver is suing another motorist for allegedly striking the plaintiff's vehicle while backing up.
Robert Kirkland filed a complaint on March 20 in the St. Clair County Circuit Court against Todd Harpole, alleging he failed to exercise ordinary care of his vehicle.
According to the complaint, the plaintiff alleges that on Oct. 12, 2016, he was driving in a northerly direction near 1100 Kingshighway at the intersection of Bunkum Road when the front of his vehicle was struck.
As a result, Kirkland claims he suffered physical injuries, mental anguish and incurred medical bills.
The plaintiff alleges Harpole failed to keep his vehicle under proper control, failed to check all mirrors and look over his right shoulder before backing up on the roadway and operated his motor vehicle while using an electronic communication device.
The plaintiff requests a trial by jury and seeks judgment in a sum greater than $50,000 plus costs of suit and other further relief the court deems just and proper.
