Cook County process server sued for serving person under 13

BELLEVILLE — A Swansea man is suing a Cook County process server for allegedly humiliating him by abusing the process of law and serving a person under 13.

Erwin Miller filed a complaint on Feb. 28 in the St. Clair County Circuit Court against Eric Mendenhall and United Processing Inc., alleging they violated the Service of Summons Statutes.

According to the complaint, the plaintiff alleges that on Aug. 3, 2016, he was embarrassed and humiliated when he was arrested, handcuffed, taken to jail and required to post bond of $3,000.

He claims the defendants failed to follow the statutes and abused the process of law by making service on a person under the age of 13 at the his residence.

The plaintiff requests a trial by jury and seeks judgment against defendants in a sum exceeding $50,000.
