EAST ST. LOUIS — A Centreville man is suing Specified Credit Association 1 Inc., a debt collector, citing alleged false, deceptive or misleading representation.
Kenneth Ball filed a complaint on Feb. 13 in the U.S. District Court for the Southern District of Illinois alleging that the Maryland Heights, Mo. debt collector violated the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that the defendant’s unlawful collection attempts and misrepresentations have caused him to incur actual damages, attorney's fees, denial of credit, frustration and anxiety. The plaintiff holds Specified Credit responsible because it allegedly failed to provide the mini-Miranda warning, ignored and overshadowed his rights to dispute, validate and verify the debt and impliedly threatened him with a lawsuit if he did not pay.
The plaintiff requests a trial by jury and seeks actual and statutory damages, costs of litigation and such other relief as the court may deem proper. He is represented by Thomas R. Applewhite of Donner Applewhite, Attorneys At Law, in St. Louis.
