Millstadt homeowners allege construction defects

BELLEVILLE – Two Millstadt homeowners are suing a construction company over alleged defects in the construction of a new house.

Mark Kistner and Sheree Yeager filed a consumer fraud complaint on Feb. 28, in the St. Clair County Circuit Court against Kappert Construction Co. Inc., alleging the defendant failed to perform every aspect of the agreement implicitly warranted and guaranteed by them.

According to the complaint, the plaintiffs allege that on June 5, 2015, the plaintiffs contracted with the defendant to construct a new home for a sales price of $299,176. After performing all obligations, the plaintiffs moved into the new property and noticed significant deficiencies in the construction of the house. They claim they notified the defendant, who refused to correct the deficiencies. 

The plaintiffs allege Kappert Construction failed to abide by the agreed contract and ignored any arbitration clause sent by the plaintiffs.

The plaintiffs request a trial by jury and seek judgment in an amount of more than $50,000 for compensation, damages and any other further relief the court decides is appropriate.
