BELLEVILLE — A man claims he was not informed that his Firearms Owners Identification Card (FOID) had been revoked and was convicted for illegal possession of a firearm as a result.
Warren J. Huff filed a complaint on Feb. 24 in St. Clair County Circuit Court against Jessica Trame, Chief of the Firearms Services Bureau of the Illinois State Police, and officers and employees of the Illinois State Police known as Does 1-50, alleging negligent spoliation of evidence and failure to notify.
According to the complaint, the plaintiff alleges that on Feb. 26, 2016, he was arrested by a police officer on charges related to illegal possession of a firearm after he was pulled over for a routine traffic stop.
Huff claims he had no knowledge that his FOID card was revoked because the card had an expiration date of May 1, 2024.
The plaintiff alleges the defendants failed to provide written notice that his FOID card had been revoked, failed to take any other steps to notify him and failed to provide copies of his FOID application and any records of the notification of the revocation.
The plaintiff requests a trial by jury and seeks judgment in an amount in excess of $50,000, plus costs of suit, and such other relief as allowed by law.
