BELLEVILLE — A driver who allegedly struck a pedestrian in a crosswalk in Fairview Heights is being sued.
Cheryl Bunfill and Brian Bunfill filed a complaint in the St. Clair County Circuit Court against Donald Brown, alleging that the defendant failed his duty to exercise reasonable care in the operation of his motor vehicle.
According to the complaint, the plaintiffs allege that on Sept. 3, 2015, plaintiff Cheryl Bunfill was walking in North Ruby Lane and had entered the crosswalk intersection when she was struck by the defendant's motor vehicle, causing physical injuries. As a result, Brian Bunfill, her husband, has suffered a loss of his wife's consortium. The plaintiffs hold Brown responsible because the defendant allegedly failed to yield the right of way to a pedestrian within a crosswalk, failed to properly apply the brakes of his vehicle and failed to keep a proper and sufficient lookout.
The plaintiffs request a trial by jury and seek judgment for an amount in excess of $50,000 and any other further relief the Court deems just and appropriate. They are represented by John Womick of Womick Law Firm in Carbondale.
