Transportation company alleges failure to pay

EAST ST. LOUIS — A transportation company is suing CSX Transportation, Inc., citing alleged failure to pay for completed work.

The Alton and Southern Railway Company filed a complaint on Feb. 27 in the U.S. District Court for the Southern District of Illinois against CSX Transportation, Inc., alleging the defendant failed to pay blocking and holding charges assessed pursuant to applicable agreements.

According to the complaint, the plaintiff alleges that between March 2014 and June 2016, the Alton and Southern Railway Company performed all freight services and agreed to provide blocking and holding services to the defendant in exchange for payment of the associated charges.

The plaintiff claims it satisfied all terms and conditions of the contracts and provided all services but failed to receive payments amounting to $3,254,785.07.

The plaintiff alleges the defendant failed and refused to pay the charges due for the services rendered and as agreed by signed contract.

The plaintiff requests a trial by jury and seeks judgment in the amount of $3,254,785.07, plus accrued interest, costs of this suit, attorney fees, and other such relief as the Court deems just and proper.
