Belleville woman says debt collector demanded payment of discharged debt

EAST ST. LOUIS — A Belleville resident is suing a debt collector for allegedly attempting to collect a discharged debt.

Virginia Y. Howell filed a complaint on Feb. 2, in the U.S. District Court for the Southern District of Illinois against First National Collection Bureau Inc. alleging that the Nevada-based debt collector violated the Bankruptcy Discharge Injunction.

According to the complaint, the plaintiff alleges the defendant attempted to collect a debt by sending payment demands directly to Howell despite allegedly having knowledge of her bankruptcy discharge. 

As a result, she claims she suffered emotional distress and inconvenience and has incurred attorney’s fees.

The plaintiff requests a trial by jury and seeks an order for the deletion of adverse credit report related to her debt, award for statutory damages, attorney fees and any other relief as the court deems just and appropriate.
