Motorist sued over East St. Louis rear-end collision

BELLEVILLE — Two motorists are suing another driver for allegedly causing a rear-end collision in East St. Louis.

Gary Payne and Penner Perkins filed a complaint on Feb. 4 in the St. Clair County Circuit Court against Erica M. Cotton, alleging she breached her duty to exercise ordinary care and caution for the safety of others.

According to the complaint, the plaintiffs allege that on April 11, they were traveling southbound on Kings Highway in East St. Louis. While they were stopped at a red light, the defendant allegedly collided with the back of their vehicle.

They claim they sustained injuries that are permanent and pecuniary in nature.

The plaintiffs allege Cotton failed to maintain a careful lookout, drove her vehicle at a speed greater than reasonable and failed to timely stop the vehicle to avoid a collision.

The plaintiffs seek judgment against the defendant in an amount exceeding $50,000, plus costs of this suit.
