Guest sues homeowner over slip, fall on rug

EDWARDSVILLE — A St. Clair County woman is suing a Madison County homeowner after she allegedly slipped on a rug.

Debra C. Agee filed a complaint on Feb. 14 in the Madison County Circuit Court against Earl Modesto, alleging the homeowner breached his duty to provide safe walkway surfaces.

According to the complaint, Agee alleges that on Dec. 6 she was invited to the defendant's residence. While there, she claims a rug runner moved underneath her feet, causing her to slip and fall in the hallway and staircase area. 

As a result, she claims she sustained injuries resulting in great pain and mental anguish, loss of normal life and medical expenses, the complaint states.

The plaintiff alleges Modesto failed to provide adequate lighting in the area and failed to warn her of the existence of the dangerous condition.

The plaintiff seeks judgment against defendant in excess of $50,000, plus costs of this suit.

She is represented by Brian M. Wendler of Wendler Law PC in Edwardsville.
