Mother sues driver who allegedly hit son while walking

BELLEVILLE — A mother is suing a driver for allegedly hitting her son while he was walking, causing him injuries.

Kiara Agnew filed a complaint on Feb. 2 in the St. Clair County Circuit Court against Winnie Davis, alleging the driver failed to exercise due care to avoid collision.

According to the complaint, the plaintiff alleges that on April 14, her son, Jace Agnew, was a pedestrian walking at Donald Street near the intersection of Holloran in Cahokia when the defendant's vehicle struck him.

As a result, he allegedly suffered physical injuries and emotional distress and required medical care and treatment, the suit states.

The plaintiff alleges the defendant failed to keep proper lookout for other people, failed to properly apply brakes and operated her vehicle at an excessive rate of speed.

The plaintiff requests a trial by jury and seeks judgment in a sum in excess of $50,000 and the cost of suit.

She is represented by William A. Boker III of The Mattea Law Firm in Collinsville.
