Property owners sue insurer for alleged breach of contract

BELLEVILLE — Two property owners allege an insurer has failed to satisfactorily settle their claim.

Jonathan and Carla Hubbard filed a complaint on Jan. 10 in St. Clair County Circuit Court against United Services Automobile Association, Rehkemper Construction Co. and Huntington Chase Homes Corp., alleging they breached their duty to fulfill their contractual obligations.

According to the complaint, the plaintiffs allege that on Dec. 26, 2015, they sustained property damage due to high winds. They allege they timely filed a claim and fulfilled their contractual requirements for the loss, but to date their claim has not been settled satisfactorily.

The plaintiffs allege USAA refused and continues to refuse to tender insurance benefits, Rehkemper failed to construct trusses in a good and workmanlike manner and Huntington failed to install the trusses properly.

The plaintiffs request a trial by jury and seek judgment against each defendant in an amount in excess of $50,000, plus costs of this suit and other just and proper relief.
