Breese motorist sues delivery service following collision

EAST ST. LOUIS – A Breese motorist is suing a delivery service after one of its drivers allegedly caused a collision.

Zachary W. Luebbers filed a complaint on Jan. 17 in the U.S. District Court for the Southern District of Illinois against Fiers Delivery Service LLC, Fiers Logistics LLC and Gary M. Bell, alleging the corporate defendants negligently entrusted their vehicle to Bell.

According to the complaint, the plaintiff alleges that on Dec. 22, he was driving a 2005 GMC Sierra westbound on State Route 161 near its intersection with Tony Road when Bell allegedly drove across the center line and collided with his vehicle.

Luebbers alleges he sustained severe injuries that resulted in medical expenses, pain and suffering, disability and loss of wages.

The plaintiff alleges Bell failed to keep a proper lookout, failed to keep the vehicle he was driving under control and drove the vehicle at excessive speed.

The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $75,000, costs of this suit and all other relief as the court deems just and proper.
