Insurer says motorist negligently damaged street sweeper

EDWARDSVILLE — An insurance provider for the City of Alton is suing a motorist for allegedly damaging a street sweeper in a collision.

Illinois Municipal League Risk Management Association, a/s/o City of Alton, filed a complaint on Jan. 17 in Madison County Circuit Court against Gary Claxton, alleging he negligently caused damage to a city street sweeper that was insured by the plaintiff.

According to the complaint, the plaintiff alleges that on May 8, the street sweeper, insured by the plaintiff, was traveling southbound on Washington Avenue in Alton. Claxton attempted to pass the street sweeper, causing his trailer and track hoe to strike the sweeper.

As a result, the plaintiff alleges it suffered damages, depreciation and incurred losses in the amount of $206,500.

The plaintiff alleges Claxton failed to yield right of way, failed to keep careful lookout and failed to maintain proper control of his vehicle.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $206,500, plus costs of this suit.
