Construction company sues contractors for alleged breach of contract

EDWARDSVILLE — A construction company is suing contractors for allegedly failing to make payments.

Lumberyard Suppliers Inc., doing business as LS Building Products filed a complaint on Jan. 11, in the Madison County Circuit Court against AMP Construction & Restoration LLC and John Michael Settlemyer, alleging they failed to fulfill their obligations under the terms of the promissory note.

According to the complaint, the plaintiff alleges that on April 14, 2016, in exchange for goods and valuable considerations, the defendants executed a promissory note in favor of Lumberyard Suppliers in the amount of $235,000. As of Jan. 5, 2017, the balance of $99,995.37 remains due and owing.

The plaintiff alleges the defendants failed and refused to make payments for the said balance account.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, in the sum of $99,995.37, plus interest, attorney's fees and costs of this suit.
