Property owner alleges bar and grill operators damaged property

EDWARDSVILLE — A property owner is suing bar and grill operators for allegedly damaging the property and failing to pay for repairs. 

Noreen Faye Kelsey filed a complaint on Jan. 17 in the Madison County Circuit Court against Louise E. Benham, Stephanie L. Benham and 2001 Hildebrand Inc., alleging they failed to comply with the terms and conditions of the promissory note.

According to the complaint, Kelsey claims the defendants operate a bar and grill and allegedly damaged the property.

As a result, Kelsey alleges she had to expend time and money repairing the damages and has not received the full payment of $61,200 for the repairs.

The plaintiff alleges the defendants failed and refused, and continue to fail and refuse, to tender payments and misused and altered plaintiff's property.

The plaintiff requests a trial by jury and seeks judgment against defendants in excess of $50,000 for each of them, attorney's fees, interest and costs of this suit.
