Motorist, vehicle owner sued following collision

EDWARDSVILLE — A motorist is suing another driver and the vehicle's owner for allegedly causing a collision.

Cory Rice filed a complaint on Jan. 12 in the Madison County Circuit Court against Diana Foster, Mollie Palmer and Dustin Freytag, alleging Palmer negligently entrusted her vehicle to an unlicensed and careless driver.

According to the complaint, the plaintiff alleges that on Jan. 12, 2015, he was operating a 2004 Lincoln LS and was stopped at traffic in the southbound lane of Stanley Road at its intersection with Illinois Rt. 111. At the same time, Foster approached the intersection and negligently collided with the driver's side of plaintiff's vehicle, the suit states.

As a result, Rice claims he sustained severe and permanent injuries, loss of income and medical expenses.

The plaintiff alleges Foster and Freytag failed to operate the vehicle they were driving in a safe manner and failed to maintain careful lookout.

The plaintiff requests a trial by jury and seeks judgment against each defendant for $50,000, pre-judgment interest, costs of this suit and all other relief as the court deems just and appropriate.
