Nursing home alleges resident failed to pay

EDWARDSVILLE - A nursing home facility is suing a resident for failing to pay for services.

Godfrey Healthcare and Rehabilitation Center LLC filed a complaint on Dec. 21, in the Madison County Circuit Court against John Toigo, alleging the resident failed to perform his contractual obligations.

According to the complaint, Godfrey Healthcare alleges it provided nursing home and skilled care to Toigo, but he failed to pay for his care. After all credits and offsets have been applied, the balance of $121,250.14 remains due and owing, the suit states.

The plaintiff alleges Toigo failed and refused to make payments for the services provided.

The plaintiff requests a trial by jury and seeks judgment against defendant in an amount in excess of the jurisdictional limits of the court, plus interest, litigation costs and all other relief that the court may deem just and proper.
