First Student, bus driver blamed for injuries in crash

BELLEVILLE — A school-bus passenger is suing the bus driver, alleging that insufficient measures were taken to prevent injuries.

Earline Fikes of Cahokia filed a complaint on Nov. 16 in St. Clair County Circuit Court against Rita McCall and First Student Inc., alleging they breached their duty of reasonable care in operating a school bus.

According to the complaint, the plaintiff alleges that on Feb 12, 2015, she was a passenger in a school bus being driven by McCall in Sauget when the bus left the roadway and struck a culvert. As a result, she sustained injuries and damages resulting in pain, medical bills and loss of normal life, she alleges.

The plaintiff alleges McCall, as an agent of First Student, allegedly drove the school bus faster than reasonable and failed to maintain careful lookout.

The plaintiff requests a trial by jury and seeks judgment against each defendant in excess of $50,000, plus costs of this suit.

She is represented by Jon E. Rosentengel of Bonifield & Rosentengel PC in Belleville.
