Apex Physical Therapy says former employees violated agreements

Contract 10

EDWARDSVILLE — A physical therapy business is suing former employees for alleged breach of contract.

Apex Physical Therapy LLC filed a complaint on Dec. 16 in the Madison County Circuit Court against Zachary Ball, Todd Linebarger and Advanced Physical Therapy, alleging Ball violated a non-compete agreement and Linebarger violated a confidentiality agreement.

According to the complaint, the plaintiff alleges it  suffered damages to its business when former employees Ball and Linebarger created a competing company and violated agreements in the process.

The plaintiff alleges the defendants used Apex's referral source to secure work for Advanced.

The plaintiff requests a trial by jury and seeks compensatory damages, and any further relief this court grants.

It is represented by Matthew A. Jacober and Patricia L. Silva of Lathrop & Gage LLP in St. Louis.
