Plaintiffs claim Shady's improperly served intoxicated customer

BELLEVILLE — Two plaintiffs accuses a Summerfield tavern operator of violating the Dram Shop Act by unlawfully selling alcohol to an intoxicated person.

John Doe and Jane Doe filed a complaint on Nov. 10 in St. Clair County Circuit Court against GNS LLC d/b/a Shady's, alleging the tavern operator violated the Dram Shop Act.

According to the complaint, the plaintiffs allege that on Nov. 14, 2015, they sustained injuries when patron Kevin White became intoxicated and was unable to control his actions.

 As a result, they claims they suffered pain, loss of income, loss of consortium and medical expenses.

The plaintiffs allege the defendant negligently served alcohol to an intoxicated White.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount consistent with this cause of action, plus costs of this suit.
