EDWARDSVILLE — First Midwest Equipment Finance is suing a trucking company and its owner for allegedly failing to make payments.
First Midwest Equipment Finance Co. filed a complaint on Dec. 2, in the Madison County Circuit Court against Wheeler Trailer Leasing Inc. and Brian Wheeler, alleging breach of contract.
According to the complaint, the plaintiff alleges that on Aug. 1, it executed an agreement with the defendants, whereby First Midwest agreed to finance equipment for Wheeler in an amount of approximately $340,000.
The plaintiff alleges the defendants failed to make payments for the amounts due and owing and wrongfully detained the financed equipment.
The plaintiff requests a trial by jury and seeks an order of replevin against defendants for the possession of the subject equipment, the value of the undelivered equipment and damages for the wrongful detention of the equipment.
