Owner of Worden rental home sued over porch with no railing

A woman is suing the owner of a Worden rental home after she allegedly fell off the porch.

Erin Stambaugh filed a complaint on Nov. 10, in the Madison County Circuit Court against Robert Behme for allegedly negligently failing to properly maintain the porch of the rental house.

According to the complaint, the plaintiff alleges that on Nov. 9, 2014, she was moving a box into Behme's rental house, located at 501 Carson in Worden. While there, she claims she she fell off the porch, which has no railing.

As a result, Stambaugh claims she sustained injuries that made her sick, sore, lame and disordered. She also suffered pain and suffering, lost wages, disability, disfigurement and medical expenses.

The plaintiff alleges Behme failed to ensure that the porch had proper railing and failed to warn the plaintiff of the dangerous condition.

The plaintiff requests a trial by jury and seeks compensation for damages in an amount in excess of $50,000, plus cost of this suit and all other relief as the court deems just.
