Family accuses motorist of negligence in rear-end collision

EDWARDSVILLE — A Madison County family is suing another motorist, alleging he took insufficient measures to avoid a vehicle collision.

Kristen Palmisano, individually and as mother and next friend of minor Vincent Palmisano, and Edward Palmisano filed a complaint on Nov. 4 in Madison County Circuit Court against Guy Rowland, alleging the defendant failed to operate his vehicle in a reasonably safe manner.

According to the complaint, the plaintiffs allege that on Nov. 27, 2014, Edward Palmisano was operating a motor vehicle, which was also occupied by Kristen Palmisano and Vincent Palmisano. He claims he was stopped behind a vehicle waiting to make a left turn when the defendant drove his vehicle into the rear of the Palmisanos' vehicle.

As a result, the plaintiffs sustained injuries resulting in great pain and suffering, mental anguish and medical expenses, the suit says.

The plaintiffs allege Rowland failed to maintain careful lookout, failed to reduce speed to avoid a collision and failed to yield right of way.

The plaintiffs request a trial by jury and seek judgment in excess of $50,000 for each of them, plus costs of this suit.
