Woman claims Metro driver caused crash

BELLEVILLE — A passenger is suing transportation provider Bi-State Development Agency, d/b/a Metro, and its employee Jona Ellis, alleging negligence in connection with a vehicle collision.

Mary Phinney filed a complaint on Oct. 20 in St. Clair County Circuit Court against the defendants, alleging that Ellis failed to maintain proper control of the vehicle.

According to the complaint, the plaintiff alleges that on Oct. 27, 2015, she was a passenger in a motor vehicle traveling on Mississippi Avenue in Centerville when Ellis, driving a Metro vehicle, struck the vehicle in which the plaintiff was a passenger, causing her physical and emotional injuries, disfigurement, medical expenses and lost wages. The plaintiff holds the defendants responsible because Ellis, in his capacity as a Metro employee, allegedly failed to maintain careful lookout, failed to timely apply the brakes and failed to yield right of way.

The plaintiff requests a trial by jury and seeks judgment against each defendant for a fair and just award exceeding $50,000, plus costs of this suit. She is represented by Lloyd M. Cueto of Law Offices of Lloyd M. Cueto PC in Belleville.
