State Farm Mutual Automobile Insurance Company says man hasn't paid note

Insurance 04

BELLEVILLE — An insurer is suing Adam Devore, a St. Clair County motorist, citing alleged failure to pay.

State Farm Mutual Automobile Insurance Company, as subrogee of Gale Baker, filed a complaint on Oct. 11 in St. Clair County Circuit Court against Devore, alleging that he failed to comply with the terms of a promissory note.

According to the complaint, the plaintiff alleges that on April 1, 2010, an automobile being operated by Devore collided with a vehicle operated by plaintiff's insured, Baker. As a result, the plaintiff allegedly paid its insured for the injuries and damages she sustained. The plaintiff holds Devore responsible because on Dec. 9, 2013, the defendant allegedly executed a promissory note for the settlement of damages suffered by the plaintiff as subrogee of Baker, but has not paid the note to date.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the sum of $103,428.85 plus interest minus any payments, attorneys' fees, costs and expenses for this action. He is represented by Yudkin & Brebner PLLC in Waukegan.
