BELLEVILLE — The Village of Washington Park is being sued by businesses alleging temporary nuisance and negligent trespass following sewage backups.
Jake Properties Inc., Fish Inc. and First Amendment Inc. filed a complaint on Oct. 3 in St. Clair County Circuit Court against the Village of Washington Park, alleging that the municipal corporation failed to properly design, construct and maintain a sewage system.
According to the complaint, the plaintiffs allege that they have suffered property damages, loss of business revenues and cleanup expenses due to repeated backups of raw sewage.
The plaintiffs hold the Village of Washington Park responsible for allegedly failing to perform necessary repairs and/or modifications to make the sewer system operable.
The plaintiffs request a trial by jury and seek judgment against the defendant, costs, pre-judgment interest and all other relief as the court deems just and proper. They are represented by Paul T. Slocomb of Hoffman Slocomb LLC in St. Louis.
