Motorist accused of negligence following fatal collision

BELLEVILLE — A special administrator of a deceased woman's estate has filed a wrongful death claim against a motorist, alleging negligence in connection with a vehicle collision.

Gaylon Scoby of Cahokia, as special administrator of Marilyn Scoby, deceased, filed a complaint in St. Clair County Circuit Court against Paula Schaefer, alleging that the defendant breached her duty to exercise ordinary care in the operation of her motor vehicle to protect other people and property.

According to the complaint, the plaintiff alleges that on June 2, Marilyn Scoby was riding in the front seat of a vehicle being operated by Gaylon Scoby when the defendant caused her vehicle to collide with the plaintiffs' vehicle, violently impacting the passenger side.

Both of the Scobys suffered severe injuries, resulting in great pain and suffering and medical expenses, the suit alleges.

The suit claims that Marilyn Scoby died on June 7 and that Gaylon Scoby will continue to suffer loss of society of Marilyn Scoby.

The plaintiff holds Schaefer responsible because the defendant allegedly failed to maintain careful lookout, failed to keep proper speed upon entering a city intersection and failed to yield the right of way.

The plaintiff requests a trial by jury and seeks compensation for damages in an amount in excess of $50,000 and costs of this suit. He is represented by John J. Hopkins of John J. Hopkins & Associates PC in Alton.
