Driver, passenger sue motorist over collision

Car accident 12

BELLEVILLE — A driver and passenger are suing another motorist, alleging negligence in connection with an automobile collision.

Terence Hunt and Eugene Jackson filed a complaint on Sept. 30 in St. Clair County Circuit Court against Donald Benton, alleging that the motorist breached his duty to exercise reasonable care and caution for the safety of others.

According to the complaint, the plaintiffs allege that on Oct. 2, 2015, Jackson was passenger in a vehicle being operated by Hunt, traveling directly in front of the defendant's vehicle, when suddenly the defendant's vehicle collided with the rear of the plaintiffs' vehicle.

The plaintiffs claim they sustained severe and permanent injuries resulting in great pain and suffering, medical expenses, lost wages and loss of earning capability.

The plaintiffs hold Benton responsible because the defendant allegedly failed to keep proper lookout, failed to maintain proper control of his vehicle and failed to observe other vehicles on the road while operating his vehicle.

The plaintiffs request a trial by jury and seek judgment against the defendant in an amount exceeding $50,000, plus costs of suit and for any other relief the court deems proper. They are represented by Ronald J. Foster Jr. of Walton Telken Foster LLC in Edwardsville.
