EDWARDSVILLE – A man alleges he was wrongfully terminated after he was injured on the job and requested workers' compensation.
Edward Holmes filed a complaint on Oct. 26 in Madison County Circuit Court against Construction Turnaround Services (CTS), Don Schexnider, Grant Dalton and Aaron May alleging intentional interference with his economic advantage.
According to the complaint, the plaintiff alleges that he was injured while working at Phillips 66 in Wood River under the employment of CTS. As a result of his injuries, he alleges he requested workers' compensation benefits from CTS and that on Oct. 1, 2015, he was terminated from his employment.
Holmes claims he has suffered and will continue to suffer lost wages and benefits.
The plaintiff alleges CTS retaliated against him by discharging him from his employment for exercising his rights for requesting workers' compensation benefits and defendants Schexnider, Dalton and May provided inaccurate information related to the workers' compensation complaint.
The plaintiff seeks judgment in his favor in an amount exceeding $50,000 from each defendant, plus costs of suit and interest and any other relief as the court deems just. He is represented by Michael J. Brunton and Mary M. Stewart of Brunton Law Offices PC in Collinsville.
