Woman seeks compensation from motorist for crushed leg

EDWARDSVILLE — A passenger is suing a motorist for allegedly backing into another car and crushing her leg while she rode in the back of a pickup truck.

Colleen Condray filed a complaint on Oct. 25 in Madison County Circuit Court against Nicholas Holthaus, alleging he failed to exercise the highest degree of care to protect his passenger.

According to the complaint, the plaintiff alleges that on July 30, she was riding in the rear of the defendant's pickup truck when he suddenly backed into a car, crushing her right leg between the two vehicles.

As a result, Condray alleges pain and suffering, lost wages and medical expenses.

The plaintiff alleges Holthaus failed to maintain careful lookout, negligently backed into another vehicle and failed to operate his vehicle in a safe manner.

The plaintiff requests a trial by jury and seeks compensation for damages in a reasonable amount in excess of $50,000, plus interest, costs for this action and such other relief as the court deems necessary. She is represented by Benjamin J. Sansone of Sansone, Summer & Lauber in Clayton, Missouri.
