Pedestrian claims dog attacked her on street

BELLEVILLE — A pedestrian is suing a pet owner after she was allegedly attacked by a dog while walking down the street.

Jessica Durham filed a complaint on Sept. 26 in St. Clair County Circuit Court against Vivian Baker, alleging that the pet owner failed to train her dog not to attack people on a roadway.

According to the complaint, the plaintiff alleges that on Jan. 4, she was lawfully walking on the street in the 900 block of North 39th Street without any provocation on her part when she was attacked by the defendant's dog.

She claims she suffered injuries resulting in disability, pain and suffering and medical expenses.

The plaintiff alleges Baker failed to properly restrain her dog.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount exceeding $50,000, plus costs of this suit. She is represented by Chet A. Kelly of Foley & Kelley LLC in Belleville.
