BELLEVILLE — A driver is suing fellow motorist Kitty Lin, a Swansea resident, alleging insufficient measures were taken to prevent injuries.
Theresa Gibson filed a complaint on Sept. 21 in St. Clair County Circuit Court against Lin, alleging that the Swansea motorist failed to exercise the highest degree of care to avoid a collision.
According to the complaint, the plaintiff alleges that on May 27, 2015, she was lawfully operating a motor vehicle when the defendant, who was operating a motor vehicle in a reckless manner, suddenly collided with the plaintiff's vehicle. The plaintiff sustained injuries that resulted in extreme pain, lost wages and medical care and treatment expenses. The plaintiff holds Lin responsible because the defendant allegedly drove her vehicle at an excessive rate of speed, failed to keep a careful lookout and followed her too closely.
The plaintiff requests a trial by jury and seeks compensation for a reasonable amount in excess of the jurisdictional limits of the court and for such other and further relief that is fair to compensate her damages, plus costs and expenses.
