Motorist says collision was fault of other driver

BELLEVILLE — A driver claims that fellow motorist Edward F. Warwick, a Missouri resident, caused a collision due to negligence and insufficient measures taken to prevent injuries.

Desarael A. Black filed a complaint on Sept. 16 in St. Clair County Circuit Court against Warwick, alleging that the Missouri motorist failed to exercise the highest degree of care in operating a motor vehicle.

According to the complaint, the plaintiff alleges that on Oct. 1, 2014, he was lawfully operating his motor vehicle when the defendant collided with the rear driver side portion of his vehicle. The incident caused the plaintiff to sustain injuries and suffer great pain and loss of enjoyment of life, and to incur medical care expenses, the suit says. The plaintiff holds Warwick responsible because the defendant allegedly failed to keep careful lookout, drove his vehicle at an excessive rate of speed and failed to change direction to avoid a collision.

The plaintiff requests a trial by jury and seeks judgment against the defendant in excess of $50,000, costs expended for this action and for other and further relief. He is represented by Steven S. Fluhr of Fluhr & Moore LLC in St. Louis.
