Woman claims collision stemmed from unsafe U-turn

Car accident 43

BELLEVILLE — A driver is suing fellow motorist Michael P. Herr, alleging negligence and insufficient measures taken to prevent injuries.

Candis S. Sobol filed a complaint on Sept. 15 in St. Clair County Circuit Court against Herr, alleging that the defendant failed to maintain proper control of his vehicle.

According to the complaint, the plaintiff alleges that on Sept. 20, 2014, she was operating a motor vehicle with her 1-year-old daughter when the defendant made an improper U-turn, colliding with the plaintiff's vehicle and causing her injuries that resulted in pain and suffering, disability and medical expenses. The plaintiff holds Herr responsible because he allegedly failed to keep proper lookout, attempted to make a U-turn when it was unsafe to do so and failed to operate his vehicle in a single lane of traffic.

The plaintiff requests a trial by jury and seeks compensation for an amount in excess of the jurisdictional limits of the court, plus costs of this lawsuit. She is represented by Brady M. McAninch and John T. Hipskind of Hipskind & McAninch LLC in Belleville.
