Customer alleges injuries from trip and fall in Wal-Mart parking lot

BELLEVILLE — A woman claims she was injured when she stepped in a pothole in the Wal-Mart parking lot.

Audra Barnes filed a complaint in St. Clair County Circuit Court against Wal-Mart Stores Inc., alleging that the retail store operator breached its duty to exercise reasonable care.

According to the complaint, the plaintiff alleges that on Sept. 21, 2014, she was returning to her vehicle after shopping at Wal-Mart when her foot slipped into a pothole in the parking lot, causing her to fall and sustain injuries that resulted in medical expenses, pain and suffering and lost wages.

Barnes alleges the defendant allowed the dangerous condition to exist on its premises and failed to repair the pothole.

The plaintiff requests a trial by jury and seeks judgment against the defendant in an amount in excess of $50,000, plus costs for this action and any other relief the court deems proper. She is represented by Paul J. Evans and Benedict Young of Evans Law Firm PC in O'Fallon.
