City of Edwardsville sued after driver struck fallen tree

EDWARDSVILLE — A passenger alleges injuries when the vehicle she was riding in struck a fallen tree.

Debra Simmons, as guardian and next friend of Lisa Lynn Newbury, filed a complaint on Sept. 29 in the Madison County Circuit Court against Jeanne Lee Newbury, the City of Edwardsville and Richard's Brick Company Inc., alleging negligence and insufficient measures taken to prevent injuries.

According to the complaint, the plaintiff alleges that on Sept. 22, 2014, Lisa Lynn Newbury was a passenger in a vehicle driven by Jeanne Lee Newbury on Highway 143 in Edwardsville when a tree on the property of Richard's Brick Company fell onto the road. Jeanne Lee Newbury struck the tree, severely injuring Lisa Lynn Newbury.

The plaintiff alleges the defendants breached their duty and failed to exercise reasonable care.

The plaintiff requests a trial by jury and seeks judgment against defendants in an amount in excess of $50,000, plus costs of suit. She is represented by Thomas G. Maag of Maag Law Firm LLC in Wood River.
